DMCA COPYRIGHT INFRINGEMENT POLICY

Praestantes (“Praestantes,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects our members to do the same. We operate http://www.praestantes.com (the “Platform”) as a private, invite-only sanctuary for the world’s foremost living artists and discerning fine art collectors. While we encourage the sharing of original insights and artistic discussions, we do not permit copyright infringement.
This DMCA Policy is incorporated into and forms part of our Terms of Service. It describes how we handle claims of copyright infringement on the Platform in accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), 17 U.S.C. § 512.
1. Designated Copyright Agent
Pursuant to the DMCA, we have designated the following agent to receive notifications of claimed copyright infringement (“DMCA Notices”):

Note: Only DMCA Notices should be sent to this address. All other inquiries (support, privacy, general questions) should be directed to the appropriate contact listed in our Terms of Service or Privacy Policy.
2. Submitting a DMCA Notice of Alleged Infringement
If you are a copyright owner (or authorized to act on behalf of one) and believe that content on the Platform infringes your copyright, please send a written DMCA Notice to our Designated Agent that includes all of the following information (as required by 17 U.S.C. § 512(c)(3)):
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work(s) claimed to have been infringed. If multiple works are involved, provide a representative list.
- Identification of the material that is claimed to be infringing, including information reasonably sufficient to permit us to locate the material on the Platform (e.g., a direct URL or detailed description of the location).
- Your contact information, including your name, mailing address, telephone number, and email address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Counterfeit or Misleading Notices: Anyone who knowingly materially misrepresents that material is infringing may be liable for damages (including costs and attorneys’ fees) under Section 512(f) of the DMCA.
3. Our Response to DMCA Notices
Upon receiving a valid DMCA Notice, we will:
- Promptly investigate the claim.
- Remove or disable access to the allegedly infringing material.
- Notify the member who posted the material (if identifiable) and provide them with a copy of the Notice.
- Take whatever other action, in our sole discretion, we deem appropriate, up to and including termination of the member’s account for repeat infringers.
We reserve the right to terminate, in appropriate circumstances and at our sole discretion, the accounts of members who are repeat infringers.
4. Counter-Notification
If you believe that material you posted was removed or disabled as a result of a mistake or misidentification, you may file a Counter-Notification with our Designated Agent that includes all of the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- Your name, mailing address, and telephone number.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if outside the United States, any judicial district in which Praestantes may be found), and that you will accept service of process from the person who provided the original DMCA Notice or an agent of such person.
Upon receiving a valid Counter-Notification, we will promptly provide a copy to the original complainant and will restore the material within 10–14 business days unless the complainant notifies us that they have filed a lawsuit seeking a court order to restrain the infringing activity.
5. Repeat Infringer Policy
It is our policy, in appropriate circumstances, to terminate the accounts of members who repeatedly infringe copyrights. We consider the number, severity, and timing of prior takedowns when determining whether to terminate an account.
